Avustralya hükümeti Sri Lanka’da işkence görme riski bulunan sığınmacının koruma talebinde bulunmak için başvuru tarihini kaçırdığını iddia ediyor.
Birleşmiş Milletler Mülteci Yüksek Komiserliği, Avustralya’nın Sri Lankalı sığınmacının koruma talebini değerlendirmeye almadan ülkesine göndermesini kınadığını açıkladı. UNHCR Avustralya hükümetinden adamın ülkeden gönderilmeyeceği ve koruma talebi için başvuruda bulunabileceği yönünde güvence talep etmişti. Ancak Çarşamba günü Villawood mülteci kampından kelepçelerle çıkarılan adam Sri Lanka’ya geri gönderildi. Avustralya hükümetin adamın 1 Ekim’deki başvuru tarihini kaçırdığını ve koruma talebinde bulunmamış olduğunu öne sürdü. Ancak adamın avukatları kendisinin Tamil halkına mensup olması ve Tamil Kaplanları ile aile bağının bulunması sebebiyle koruma talebinde bulunma hakkının olduğunu iddia ettiler. Adamın 31 sayfalık koruma talebi başvuru formunu İngilizce yardım almadan dolduramadığı, başvuru tarihi bitmeden hukuki danışmanlık da alamadığı belirtildi. Mülteci Danışmanlık Hizmetleri’nden destek aldıktan sonra Ekim ayı içerisinde adamın başvuruda bulunduğu ancak kendisine talebinin dikkate alınmayacağının söylendiği öğrenildi. Sri Lanka’ya geri gönderilen mülteciler rutin bir şekilde havaalanında gözaltına alınıyor ve mahkemeye çıkmadan önce Negombo’da gözaltında tutuluyorlar. Birleşmiş Milletler Sri Lanka’daki uygulamalar ile ilgili şu açıklamada bulunuyor: “İşkence yöntemlerinin kullanılması rutin bir şekilde devam etmektedir.” UNHCR sözcüsü Catherin Stubberfield, BM’nin hükümetin 1 Ekim olarak belirlediği başvuru tarihini kaçıran mültecilerden haberdar olduğunu dile getirdi: “Temmuz 2012’den beri sığınma talebinde bulunanlara 4 yıla kadar başvuruda bulunma imkanı tanınıyordu. Daha sonra hepsine Ekim 2016’da başvuruda bulunmaları söylendi ancak bazı sığınmacılar yeterli hukuki danışmanlığa sahip olmadıkları için bu süreci tamamlayamadılar. Bu çerçevede sığınmacının geri gönderilmesi işkence riskini beraberinde getirmekteydi.”
